Terms and Conditions – Crown Private Jets
In these Terms and Conditions, “Crown Private Jets” shall refer to Crown Private Jets, a company incorporated in the United Arab Emirates with its principal office located at Building A1, Dubai Digital Park, Dubai Silicon Oasis, United Arab Emirates.
1. Network
Crown Private Jets maintains one or more websites, webpages, and mobile apps (the “Network”) which function as an air charter services brokerage platform for users of such services (the “Charterers”). The Network may aggregate quotes for private air charter services offered by third-party aircraft operators (the “Operators”).
These Terms and Conditions govern your access to and use of the Network. By accessing or using the Network, you agree to use it solely for submitting legitimate requests to book services provided by the Operators via Crown Private Jets (the “Requests”).
Crown Private Jets may revise these Terms and Conditions at any time. Your continued use of the Network constitutes your acceptance of the Terms and Conditions in effect at that time.
2. Role of Crown Private Jets
Crown Private Jets is an air charter broker acting as an intermediary between Operators and Charterers. It arranges carriage by air by contracting aircraft from Operators on behalf of Charterers.
Crown Private Jets does not own, operate, or maintain aircraft, nor does it act as a contracting or actual carrier, whether direct or indirect. It does not provide air transportation services itself.
There is no carriage agreement between Crown Private Jets and the Charterer and/or passengers. Any agreements entered into for air carriage (the “Carriage Agreements”) are strictly between the Charterers (represented by Crown Private Jets) and the Operators. Crown Private Jets assumes no liability for any injury, damage, loss, delay, or other events resulting from the actions or omissions of Operators or third parties.
These Terms do not constitute a contract of air transportation and do not create any such contract between you and Crown Private Jets.
3. Booking of Services
Booking any charter service through Crown Private Jets will be subject to an Aircraft Charter Brokerage Contract between you and Crown Private Jets (the “Brokerage Contract”).
Neither the Network nor any proposal or quotation provided by Crown Private Jets constitutes a binding offer to contract.
Crown Private Jets reserves the right to refuse services to any individual or entity at its sole discretion.
4. Use of the Network
You represent that you are of legal age and capacity to enter into
binding agreements, including these Terms, the Brokerage Contract, and any Carriage Agreements. You must not make speculative, fraudulent, or false Requests.
You may not submit Requests or enter agreements on behalf of third parties unless legally authorized to do so.
Use of the Network is at your sole risk and expense.
5. Termination of Use
Crown Private Jets may suspend or terminate your access to the Network at any time, with or without notice or reason.
6. Ownership of Information
All content and materials on the Network, including data, text,
images, software, graphics, videos, and quotes (“Materials”), are owned by or licensed to Crown Private Jets. You may not copy, use, or distribute any Materials without prior written consent, except for
limited personal use aligned with these Terms.
7. Disclaimer of Warranties and Limitation of Liability
Information provided through the Network is offered on an “as-is” basis without warranties of any kind. Crown Private Jets makes no guarantees regarding:
Accuracy, completeness, or reliability of information; Processing or acceptance of any Request;
Execution of any Brokerage Contract or Carriage Agreement; Availability or functioning of services or the Network.
To the maximum extent permitted by applicable law, Crown Private Jets and its affiliates, officers, employees, and representatives disclaim
all liability for damages, including indirect, consequential, or loss
of profits, arising out of or in connection with:
These Terms and Conditions;
Use of the Network;
Booking or failure to book services;
Any related agreements or transactions.
8. Indemnification
By using the Network, you agree to indemnify and hold harmless Crown Private Jets, its officers, employees, agents, affiliates, and service providers (“Indemnitees”) from any loss, damage, or liability
(including legal fees) resulting from:
Your breach of these Terms, applicable laws, or third-party rights;
Use of the Network on behalf of unauthorized or misinformed third parties.
9. Personal Data
Personal data is processed in accordance with Crown Private Jets
Privacy Policy, available via the Network.
10. Miscellaneous
These Terms and Conditions represent the entire agreement between you and Crown Private Jets regarding use of the Network, superseding any prior communications.
These Terms may only be amended by Crown Private Jets in writing.
In interpreting these Terms, the singular includes the plural, masculine includes feminine, and the use of “or” is non-exclusive. Terms such as “including” or “in particular” are not limiting.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the United Arab Emirates.
Any disputes arising from these Terms shall be subject to the
exclusive jurisdiction of the courts of the Dubai International
Financial Centre (DIFC), UAE. However, Crown Private Jets reserves the right to pursue claims in any other competent jurisdiction as
necessary.
